Dr. Lucido's Follow-up Statement
to the MBC
Members of the Medical Board of California, the MBC
Division of Medical Quality, and its legal staff:
As those in attendance at the Medical Board’s DMQ meeting Friday morning,
May 6, 2005 are aware, during the public comment period, just after my
statement,

an interesting allegation was made by a patient advocate concerning the
possibility of close ties between a medical cannabis dispensary and a
doctor’s clinic.
After the patient advocate’s statement, Dr. Ronald Morton, Board Member,
came up to me and asked something to the effect “If we look into this, will
we be charged with ‘vigorous investigation?” I replied: “You’ll need to
speak with him”, indicating the person making the allegation.
Before this gets too far, I want to make a couple points of caution:
1. As California’s Attorney General said recently: all state officials are
to comply with state law when there is a conflict with Federal law. There is
no question about this.
2. If you can’t handle your job using Californian law, I would suggest you
don’t belong in State law enforcement or government, since you can’t handle
the job.
Do not use these allegations, and any resulting investigation as an excuse
to continue the DEA and federal government’s intellectually and morally
bankrupt war against sick patients, and the people of California, who are
still supportive of the California Compassionate Use of 1996 (Prop 215).
Any collusion with the DEA in this matter will further diminish the already
damaged credibility of the Medical Board in this regard.
The DEA and the White House ONDCP have been well-documented to be
“truth-challenged” on the subject of cannabis, in general, and the medical
cannabis in particular.
(I sincerely believe some heads will roll in those agencies if the truth
finally comes out, and I recommend you keep MORE than arms length, so as not
to be further tarnished yourselves.)
Meanwhile, I will use whatever support I have within the ethical medical
cannabis community to support the most ethical doctors, patients, patient
advocates, and caregivers.
